HOT TUBS SERVICING PLANS: Terms & Conditions

1. General
These terms and conditions are applicable to any 3 Star Bronze, 4 Star Silver or 5 Star Gold Annual Maintenance Contract supplied by Hot Tub Care Ltd (later referred to as “us”, “we”, “our”) and the customer (later referred to as “you”). These terms and conditions shall apply unless specifically agreed otherwise in writing by an authorised member of staff.

Our Annual Maintenance Contracts may be refused at the point of sale on the following grounds:

If the hot tub is beyond economical repair
If there is significant damage that could cause other problems
If the parts for the brand are difficult to source
If the brand or model has a reputation with unreliability
If the hot tub is difficult to access

2. Payment
The cost of the plan is either a one off annual fee, or you can opt for 12 monthly payments. When you agree to take out a plan you commit to all 12 monthly payments. Any missed payments terminate your right to any benefits of the plan.

You can terminate the contract at the end of 12 months, once all payments have been made. If you cancel at any time before the 12 months ends, the full amount of the annual contract is payable immediately.

We reserve the right to adjust the pricing and content of the contract at any time, but we will not alter an ongoing plan until it expires. All prices quoted include VAT.

3. Price and Plan Benefits

Replacement parts are chargeable, and we will be happy to provide a quotation once we have identified what you require.

4. Your Obligations
It is your responsibility to book an annual service if you wish to take advantage of a free or discounted service offered in a plan. It is your responsibility to order a new cover if you wish to take advantage of a free or discounted cover offered in a plan, and to dispose of your old one.

It is your responsibility to maintain a safe chemical balance (to BISHTA standards), and ensure the correct pH level is maintained to avoid scale or acidic water. You have to accept that some items may take a while to come into stock, but we endeavour to obtain parts within 4 weeks or sooner wherever possible. You must do all you reasonably can to keep the costs for providing this service as low as possible.

5. Exclusions
Damage caused by neglect, eg. parts corroded by scale because correct pH balance has not been maintained. Accidental or deliberate damage. Damage or faults caused by the hot tub being moved or relocated by you or another party. If you are moving house, or simply want your hot tub relocated to another part of your garden then we are happy to provide a quotation for this service, and then your plan will not be affected.

Electrical supply and wiring to the hot tub. This should only be looked at by a qualified electrician. The maintenance, repair or replacement of the following parts are excluded from the plans - headrests, cover (although you do qualify for one after 12 months on the 5 Star Gold Plan), entertainment systems like stereo, DVD or TV, cabinet, spa shell (usually acrylic), external fixtures such as gazebos, and some specialist jets when a replacement is no longer available (in these instances we will endeavour to find a suitable replacement).

6. Important Information
A fee will be charged regardless of your plan if we are called out due to an error on your part, eg. jets turned to off position, air lock from refill, dirty filters, keypad error, water chemistry or foreign object(s) in the plumbing. If in doubt please call us before we send an engineer, as we are always happy to talk you through minor issues and user errors by telephone.

- If a part is discontinued we will fit the most suitable replacement part of our choice.
- The contract does not cover hot tubs in commercial use (including rentals).
- The contract only covers hot tubs within mainland UK.
- The agreement will be invalidated if repairs or alterations are performed by anyone other than an authorised Hot Tub Care representative.
- We will not be liable for any damage to property or personal injury, unless as a result of the negligent acts or omissions of our representatives.

Nothing in these terms and conditions affects your statutory rights.

7. Transfer of Contract
At our discretion we may allow the contract to be transferred to another party should you sell your hot tub during the contract period. Please contact our office if you would like to discuss a transfer. If you sell your hot tub without obtaining our prior approval for a transfer, then the agreement will be terminated.

8. Privacy Policy
When you take out an annual contract, we need to know your name, address, telephone number, and email address. This will allow us to process your contract, but we never share your details with any third party. We may also use the information to occasionally notify you about important changes to our website, new products and special offers we think you'll find interesting. Please notify us if do not wish to receive any information.
